These terms govern your use of the SCALE Performance website and every purchase you make from it. Placing an order means you accept them, together with the Research Use Agreement, Shipping Policy and Returns Policy.

Who we sell to

You must be 21 or older to use this site or buy from it.

Our products are sold only to qualified researchers, laboratories and institutions purchasing for legitimate in-vitro and preclinical research. Purchasing without that purpose is a breach of these terms.

We may ask you to verify your research affiliation before we fulfill an order, and we may limit, decline or cancel any order. Claiming a research affiliation you do not have may be treated as fraud.

Research use only

Every product is supplied for in-vitro laboratory research use only. Products are not drugs, foods, food additives, dietary supplements, cosmetics, household chemicals, medical devices or in-vitro diagnostics, and are not for human or veterinary use or consumption of any kind. Recreational use is prohibited.

Products have not been sterilized, and have not been tested for safety or efficacy in food, drug or any other use. They must be handled only by qualified, trained research or laboratory professionals.

None of our products has been approved by the U.S. Food and Drug Administration. Nothing on this site is intended to diagnose, treat, cure or prevent any disease.

We do not provide dosing, reconstitution or administration guidance, and we will not answer questions framed around human or animal use. Telling us you intend any use other than research will result in refusal of the sale and closure of your account.

Your responsibilities as a buyer

You understand the health and safety hazards of the materials you buy and the handling controls they require, and you will handle, store, use and dispose of products in line with all applicable laws, regulations and your institution's policies, including any requirements under the Toxic Substances Control Act.

You will not resell products for human or animal consumption, relabel them, or use them to produce adulterated or misbranded goods.

You are responsible for confirming that a product is lawful to receive where you are located, and for any taxes, import certifications or licenses your jurisdiction requires.

Prices and payment

Prices are in U.S. dollars and may change without notice. We may correct pricing or listing errors, including after an order is placed, and will tell you before charging a different amount.

Payment is due in full before an order ships, by the methods offered at checkout. Once payment is authorized, an order cannot be changed; see the Returns Policy for cancellations.

Discount codes, rewards points and referral credits have no cash value and cannot be combined beyond what checkout allows.

Accounts, rewards and autoship

Keep your sign-in details private. You are responsible for activity on your account.

Rewards points are earned on merchandise after discounts, are added when an order ships, and expire after 12 months with no account activity. We may adjust points earned on orders that are cancelled or refunded.

Subscribe and Save (autoship) orders repeat on the schedule you choose until you pause or cancel them in your account. You can skip, change or cancel before the next order date at no cost.

Content on this site is for general information and education about research materials. It is not medical, legal or safety advice.

Certificates of analysis report results for the specific lot tested. They are not a guarantee of fitness for any particular purpose.

Site content, branding and design belong to SCALE Performance LLC and may not be copied or redistributed for commercial use without written permission.

Disclaimer of warranties and limit of liability

The site and products are provided as is, without warranties of any kind beyond those required by law, including any implied warranty of merchantability or fitness for a particular purpose.

We do not warrant that the site will be error-free or that products will meet your requirements.

To the fullest extent permitted by law, our total liability for any claim relating to a purchase is limited to the purchase price of the items in that order. We are not liable for direct, indirect, special, incidental, consequential or punitive damages. Some jurisdictions do not allow these limits, so they may not all apply to you.

Indemnity

You agree to indemnify and hold harmless SCALE Performance LLC and its owners, officers, staff, agents and partners from claims, including reasonable attorney's fees, arising from your purchase, handling, possession or use of any product, alone or combined with other substances, your use of this site, or your breach of these terms or of anyone else's rights.

Delays outside our control

We are not liable for delays or failures caused by events beyond our reasonable control, including backorders, carrier delays, lost shipments, customs holds, supply shortages, severe weather and service outages.

Disputes and governing law

If something goes wrong, contact us first and we will work in good faith to resolve it.

These terms are governed by the laws of the State of Georgia and applicable U.S. federal law.

General

These terms and the policies they reference are the entire agreement between us. If any part is unenforceable, the rest remains in effect. We may suspend or close accounts that violate these terms. We may update these terms; the date at the top shows the latest version.
